1. PREAMBLE

These Terms and Conditions (hereinafter "T&C") govern the contractual relationships between any natural or legal person placing an order on the website accessible at https://evignette-eu.com (hereinafter "the Website"), and QODERZ LTD, a British limited company registered under number 15048207, with registered office at 7 Bell Yard, London, WC2A 2JR, United Kingdom, and VAT number GB 469 0360 78 (hereinafter "the Service Provider").

The Service Provider offers users an online ordering service for electronic highway vignettes (e-vignettes) valid for certain European countries, under the conditions detailed below.

These T&C constitute the sole basis of the contractual relationship between the Service Provider and its Customers. Any order placed on the Website implies full, complete and unreserved acceptance of these T&C.

2. DEFINITIONS

  • Website: refers to the website accessible at https://evignette-eu.com.
  • Customer: any natural or legal person placing an electronic vignette order via the Website.
  • Service Provider: QODERZ LTD company.
  • Service: the provision of electronic vignettes valid for highway traffic in the mentioned countries.
  • Order: any firm order placed by the Customer on the Website according to the provided procedure.
  • Business days: Monday to Friday, excluding public holidays.

3. PURPOSE OF THE T&C

These Terms and Conditions aim to define the terms of provision and use of the Service offered by the Service Provider, as well as the mutual rights and obligations of the Parties in the context of using the Website and ordering electronic vignettes.

4. ENFORCEABILITY AND ACCEPTANCE OF T&C

These T&C are made available to the Customer on the Website where they can be directly consulted. They can also be communicated upon simple request by email.

The Customer acknowledges having read, understood and accepted without reservation the T&C by checking the box provided for this purpose before any order validation.

The Service Provider reserves the right to modify these T&C at any time. The applicable T&C are those in force on the date of Order validation.

5. SERVICE DESCRIPTION

The Website offers an e-vignette ordering service for use on highway networks in the following countries: Austria, Bulgaria, Hungary, Romania, Slovakia, Slovenia, Switzerland and Czech Republic.

Electronic vignettes are issued according to the following criteria:

  • Country concerned
  • Vehicle category
  • Desired validity duration (daily, weekly, monthly, annual, etc.)

The Website acts as an order intermediary and ensures the transmission of Customer data to the competent authorities in each country for vignette issuance.

Order processing is performed manually by the Service Provider's teams:

  • If the order is placed before 2 PM on a business day, it is processed the same day
  • If placed after 2 PM or on a non-business day, it is processed the next business day

The Customer receives an order confirmation and their e-vignette by email.

6. ORDER TERMS

  1. Selection of country, vehicle type, vignette duration
  2. Entry of required information (including license plate number)
  3. Validation of order summary
  4. Secure online payment
  5. Receipt by email of order confirmation and electronic vignette once registered

The Customer is responsible for the accuracy of the information provided. No modification is possible after payment validation.

7. PRICES AND PAYMENT CONDITIONS

The vignette price is automatically calculated based on:

  • The country concerned
  • The selected validity duration
  • And the vehicle category

Prices are expressed in euros, all taxes included (TTC). The total amount to pay is indicated at the time of the order summary.

Payment is made in full via a secure interface accepting the following methods:

  • Bank cards: Visa, Mastercard, American Express, CB, Maestro
  • International cards: UnionPay, Discover, JCB
  • Security protocols: Verified by Visa, Mastercard SecureCode

Payment definitively validates the order. No discount or installment payment is accepted.

8. DELIVERY CONDITIONS AND SERVICE EXECUTION

The Service consists of providing a dematerialized electronic highway vignette (e-vignette), activated for the vehicle and period selected by the Customer.

The Order is processed manually by the Service Provider's operators. Thus, execution times are as follows:

  • Orders placed before 2 PM (Paris time) on a business day: same-day processing
  • Orders placed after 2 PM or outside business days: next business day processing

The Customer receives, at the email address provided during the Order:

  • An Order summary
  • Vignette registration confirmation
  • Any supporting documents useful for its use

The Service Provider draws the Customer's attention to the fact that highway use without a valid vignette constitutes an offense in the concerned countries. It is the Customer's responsibility to carefully verify the entered data, particularly the license plate number and validity duration.

In case of error in the provided data, the Service Provider's responsibility cannot be engaged, and no refund can be demanded after Service execution.

9. RIGHT OF WITHDRAWAL

9.1. Principle

In accordance with Directive 2011/83/EU on consumer rights and the provisions transposed into French law (Consumer Code, art. L221-18 et seq.), the Customer has a withdrawal period of fourteen (14) days from the conclusion of the contract.

However, this right is excluded in the following cases, in accordance with Article L221-28 of the Consumer Code.

9.2. Exclusion of the right of withdrawal

The right of withdrawal cannot be exercised for services fully executed before the end of the withdrawal period, and whose execution began after the Customer's express agreement and express waiver of their right of withdrawal.

By validating their Order and accepting these T&C, the Customer:

  • Gives their express consent to immediate service execution
  • Acknowledges that they expressly waive their right of withdrawal

Consequently, no refund can be granted once vignette processing has started.

9.3. Special cases

The Customer retains the possibility to contact customer support (support@evignette-eu.com) to submit an exceptional request. This will be analyzed on a case-by-case basis without the Service Provider having any obligation to respond favorably.

10. RESPONSIBILITY

10.1. Obligation of means

The Service Provider is bound by an obligation of means regarding the execution of its services. They commit to processing each order rigorously, within the announced deadlines, subject to:

  • Proper use of the Website by the Customer
  • Provision of accurate and complete information
  • And absence of external or independent events (network failure, force majeure, etc.)

10.2. Errors attributable to the Customer

The Customer remains entirely responsible for the accuracy and completeness of the information they provide when ordering, particularly those relating to the vehicle's license plate number, country, validity duration and vehicle category.

In case of input error leading to incorrect vignette issuance, the Service Provider cannot be held responsible, as long as the Service was executed based on the information provided by the Customer. However, the Customer may send a written request to customer service at support@evignette-eu.com, as soon as possible following the Order.

10.3. Force majeure

The Service Provider's responsibility cannot be engaged in case of non-performance or poor performance of the contract due to force majeure, as recognized by French jurisprudence: strikes, fires, network failures, riots, major climate events, acts of war, or any cause beyond the Service Provider's reasonable control.

11. INTELLECTUAL PROPERTY

The Website content (texts, graphics, images, logos, databases, user interface, etc.) is protected by copyright, trademark rights and other intellectual property rights. Any reproduction, representation, adaptation or exploitation, in whole or in part, of the Website content, without prior written authorization from the Service Provider, is strictly prohibited and constitutes counterfeiting that may engage the civil and criminal liability of its author.

12. PERSONAL DATA

12.1. Collection and processing

In the context of Order execution, the Service Provider collects and processes certain personal data of the Customer, including:

  • Name, first name (if applicable)
  • Email address
  • Vehicle license plate number
  • IP address, navigation data

This data is processed in accordance with the General Data Protection Regulation (GDPR), for the purposes of:

  • Order processing
  • Vignette sending
  • Responding to Customer requests
  • Proof in case of dispute or control

12.2. Cookies

The Website uses the Cookiefirst solution for cookie management. The Customer can manage their cookie deposit preferences at any time via the dedicated banner on each page.

12.3. Security

The Service Provider implements all necessary technical and organizational measures to protect the Customer's personal data against any loss, unauthorized access, disclosure or alteration.

12.4. Customer rights

The Customer has the following rights regarding their data: access, rectification, deletion, opposition, portability, which they can exercise by sending an email to: support@evignette-eu.com

13. CUSTOMER SERVICE

The Service Provider provides Customers with a support service to answer any question, remark or difficulty related to the use of the Website or the execution of Services.

  • Maximum response time: 24 hours (business days)

To facilitate request processing, the Customer is invited to specify in their message:

  • Their Order number
  • The email address used for the order
  • The clear and concise subject of their request

14. ELECTRONIC PROOF AND ARCHIVING

The Customer acknowledges that electronic validation of their Order constitutes proof of their willingness to contract and makes due the amounts owed for the Order.

Data recorded on the Website servers constitutes proof of all transactions concluded between the Service Provider and the Customer.

In accordance with Article L213-1 of the Consumer Code, for any Order exceeding 120 euros, the Service Provider guarantees contract conservation for a period of 10 years and Customer access to it upon simple written request.

15. MEDIATION – AMICABLE DISPUTE RESOLUTION

In accordance with Articles L612-1 et seq. of the Consumer Code, in case of failure of amicable resolution with customer service, the consumer Customer can resort free of charge to a consumer mediator for extrajudicial dispute resolution.

The Service Provider is not currently a member of a specific mediation organization. However, the Customer can use the European online dispute resolution platform, accessible at the following address:

16. COMPETENT COURT AND APPLICABLE LAW

These T&C are governed and interpreted in accordance with English law.

Any dispute relating to their interpretation, validity, or execution of the contract concluded between the Service Provider and the Customer, which could not be the subject of amicable settlement, shall be under the exclusive jurisdiction of British courts within the jurisdiction of the Service Provider's registered office, except for imperative rules contrary to the consumer under Regulation (EU) No 1215/2012.

17. PARTIAL NULLITY – INDIVISIBILITY OF T&C

If any clause of these T&C were declared null or unenforceable in whole or in part, by a final judicial decision, this would not affect either the validity of the other clauses or that of the contract as a whole. The other provisions shall retain their full effect, unless it is an essential clause that determined the consent of one of the parties.

18. T&C MODIFICATIONS

The Service Provider reserves the right to modify these T&C at any time, without notice. Any updated version will be posted on the Website with mention of the update date.

The Customer is invited to regularly consult the T&C. Any Order subsequent to the posting of the modified version implies acceptance of the new T&C.
